Significant Rise in UK Asylum Seeker Appeals Highlights Growing Backlog

Nearly 500% increase in asylum appeals backlog raises concerns over asylum processing efficiency and costs.
The number of asylum seekers awaiting appeals in the UK has surged by nearly 500% over the past two years, prompting renewed scrutiny of the country's asylum system.

An analysis conducted by the Refugee Council indicates that, by the end of 2024, there were 41,987 asylum appeals pending in tribunal courts, a significant increase from 7,133 at the beginning of 2023.

In the final quarter of 2024 alone, 12,183 appeals were filed, following initiatives undertaken by the Labour government aimed at revitalizing asylum decision-making.

The total number of first-tier tribunal appeals lodged in 2024 has increased by 71% compared to the previous year.

This trend is correlated with a decline in the approval rate for asylum applicants, which fell to 47% in 2024, resulting in a higher volume of refusals.

The Refugee Council has pointed out that while the Home Office is working to alleviate the backlog through the recruitment of additional caseworkers and attempts to expedite initial interviews, these measures have inadvertently led to more errors in decision-making.

Enver Solomon, the chief executive of the Refugee Council, emphasized the need for improvements in first-time decision accuracy to prevent the emergence of further backlogs.

The current situation has left many asylum seekers residing in temporary hotel accommodations, unable to work or make progress in their lives, which has been described by some as a symbol of government inefficiency, potentially inflaming community tensions.

According to official statistics, as of the end of 2024, there were 38,079 individuals housed in hotels by the Home Office.

The Refugee Council estimates that if accommodation levels remain constant throughout 2025, the annual expenditure on such arrangements could reach nearly £1.5 billion.

Asylum decision-makers have attributed the increased appeal rates to procedural changes instigated by former Prime Minister Rishi Sunak, including reduced training durations for staff and limited interview times.

Additionally, the implementation of the Nationality and Borders Act 2022 has led to a heightened threshold for proving refugee status, further increasing the rate of claims being rejected.

The shortage of immigration lawyers in the UK has also exacerbated delays in the appeals process, resulting in many cases being adjourned or individuals opting to represent themselves in hearings, which is known to extend hearing durations significantly.

Under the oversight of Yvette Cooper during her tenure at the Home Office, the number of individuals receiving initial asylum decisions in the last quarter of 2024 more than doubled compared to the previous quarter.

To address the ongoing challenges, the Ministry of Justice is in the process of recruiting approximately 1,000 judges and tribunal members annually across all courts and tribunals.

In November, Lord Chancellor Shabana Mahmood announced a minimum 10% increase in civil legal aid rates for professionals working in the immigration sector.

A government spokesperson has stated that asylum claims are processed individually.

The spokesperson noted, “The asylum system we inherited was not fit for purpose, which is why we are taking urgent action to restart asylum processing and clear the backlog of cases, which will save the taxpayer an estimated £4 billion over the next two years.

We remain determined to end the use of asylum hotels over time to reduce the unacceptably high costs associated with asylum accommodation.”
