Australians Face Heatwave: Guidelines for Inflatable Pool Safety Compliance

As temperatures soar across Australia, local regulations on inflatable pools become critical for safety and legality.
This weekend, parts of New South Wales (NSW), Victoria, and South Australia are expected to experience temperatures rising up to 12 degrees Celsius above the March average, with multiple locations forecasted to hit the high 30s and low 40s.

In Melbourne and Adelaide, maximum temperatures are projected to reach the high 30s on Saturday, while Sydney is likely to experience 37 degrees Celsius on Sunday.

Inland areas may be even hotter, with Mildura in Victoria’s northwest anticipating 41 degrees Celsius and South Australia’s Renmark possibly reaching 42 degrees Celsius.

To cope with the extreme heat, inflatable and portable pools are increasingly popular among Australian families.

However, residents need to be aware that inflatable pools are governed by specific safety regulations that vary across jurisdictions.

In Australia, any portable or inflatable pool filled to a depth of 30 centimeters or more requires a compliant safety barrier as per local laws.

This requirement aims to prevent unsupervised access, especially by children, who can drown in as little as 5 centimeters of water.

The definition of a compliant safety barrier differs by jurisdiction but generally must adhere to Australian building standards rather than merely utilizing a pool cover, which is deemed insufficient.

Failure to comply with these regulations may lead to significant penalties, potentially amounting to thousands of dollars for individuals and over $100,000 for organizations or body corporates.

Royal Life Saving Australia highlights the importance of harmonizing swimming pool regulations nationwide, noting local governments play a crucial role in fostering safety awareness and compliance.

Local councils are responsible for inspecting pools, responding to complaints, and ensuring that pool safety measures are maintained, including barriers around inflatable pools.

In New South Wales, the Swimming Pools Act mandates that pool owners ensure their pools are surrounded by a child-resistant safety barrier.

The barrier must distinctly separate the pool from adjacent buildings or properties.

Victoria requires all landowners to register their pools with local councils.

Inflatable pools that do not consist of multiple components and require minimal set-up do not necessarily need a permit; however, they still must have compliant safety barriers.

Queensland has similar laws mandating pool owners to install safety barriers; inflatable pools meeting the criteria must also undergo a building development approval process and register with the Queensland Building and Construction Commission (QBCC).

Western Australia enforces strict regulations requiring safety barriers for any pools with a depth of 300 millimeters or more, which includes both temporary and portable pools.

South Australia's councils oversee compliance with safety requirements, with fines for breaches reaching up to $15,000.

Tasmania imposes penalties of up to $20,000 for non-compliant pool owners concerning safety barriers, similar to regulations in the Australian Capital Territory and Northern Territory, where swimming pools of a certain depth must also have appropriate fencing.

As temperatures rise and families seek ways to cool off, the emphasis on adhering to safety laws regarding inflatable swimming pools remains critically important for ensuring the safety of all residents, particularly children.
